The private investor can sell the property to recover the amount loaned. 3. Borrower may file bankruptcy before the Trustee Sale, in which case it will temporarily halt the sale. Investor must petition the court for a stay order to proceed with the Trustee Sale. The court will then grant the stay order but this process could take up to a year. VI.
